The costing is deemed to be exempt from disclosure by virtue of the listed exemption at Section 43(2) of the Freedom of Information Act 2000 – commercial interests.
Information is exempt information if its disclosure under the Act would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it).
We are applying Section 43(2) as a prejudice-based exemption. We may rely on this exemption if the disclosure would prejudice someone’s commercial interests (including National Highways’ own). Commercial interests may be prejudiced where a disclosure would be likely to:
· Damage our or our suppliers’ business reputation or the confidence that customers, suppliers or investors may have in us, or our suppliers.
· Have a detrimental impact on our or our supplier’s commercial revenue or threaten our or our suppliers’ ability to obtain supplies or secure finance.
· Weaken our or our suppliers’ position in a competitive environment by revealing market sensitive information or information of potential usefulness to our or our suppliers’ competitors.
It is the latter of these three points in relation to our suppliers that National Highways feels is relevant to your request. To determine where the public interest lies regarding this exemption, we have followed the ICO’s good practice advice and sought the opinion of suppliers in relation to your request.
In applying this exemption, we have had to balance the public interest in withholding the information against the public interest in disclosure. The key public interest factors for and against disclosure are attached.
