I request the following environmental information relating to the transfer of the ‘sole benefit’, including the statutory rights and obligations, arising under Sections 6 and 7 of SI2015-147:
a. All documents and completion statements which effected and facilitated the transfer of the “sole benefit” conferred on Cornwall Council under Section 6 of SI2015-147 to National Highways pursuant to Section 7 of that Statutory Instrument.
b. Any transfer deed or equivalent legal instrument by which the statutory rights and obligations, including those relating to environmental mitigation and compliance with Section 5 of Schedule 2 of SI2015-147 and the statutory approved Post Construction Monitoring Plan, were transferred from Cornwall Council to National Highways, together with confirmation of the date upon which the transfer of such rights and obligations took effect.
c. Any application, notification or submission made to the Secretary of State pursuant to Section 7 of SI2015-147 seeking approval for the transfer of the benefits, rights and obligations created by Section 6 of that Statutory Instrument.
d. Any approval, direction, consent or confirmation issued by or on behalf of the Secretary of State relating to the transfer.

The Landscape and Ecology assets of the A30 Temple to Higher Carblake scheme are still within the Aftercare Period and are being maintained by Cornwall Council. These assets are yet to be handed over to SW Operations. They are currently expected to be transferred at the end of August 2026.
The handover package of environmental information (landscape and ecology) is yet to be finalised by Cornwall Council and will then involve a joint site inspection with National Highways’ Environment team to determine whether we are content to accept the asset into Operations. In effect, there has been no transfer of responsibility of the landscape and ecology asset to National Highways other than the immediate safety grass cuts alongside the carriageway and at junctions.
